Birth Photography and Doula Contract

Birth  &  labor  are  very  unpredictable  and  therefore  these  are  not  typical  portrait  sessions.  The  lighting  may  be  dim,  and  planning what’s  going  to  happen  can  be  difficult.  I  shoot  your  labor  &  birth  as  it  unfolds,  in  a  photo-­‐journalistic  style.  I  am  sensitive  to your needs  as  a  laboring  woman  and  understand  my  role  is  to  document  quietly  and  unobtrusively.  Being  a  birth  doula,  I  also understand  which  special  moments  you  may  want  and  how  to  ensure  that  they  are  captured  forever and use a mounted flash if necessary.  Below  are  some  guidelines  to  ensure that  I  can  give  you  the  best experience  possible.  Please  read through the contract and submit the form with your information at the bottom.

Birth Doula and Photography Services Include:

·       On-call time from 38 weeks until birth of baby

·       Support and photography during active labor until 2 hours postpartum

·       Editing of images, chosen by photographer – black and white and/or color up to discretion of photographer

·       High resolution and web resolution files {watermarked}

·       Online gallery {available for 3 months to digitally download your files}

Contract
Please read through the details below and check off each section as you agree to the terms.
This agreement is between Jessica Worland Photography and client. Upon signing this contract, a retainer of $200 is due to Jessica. This retainer is non-refundable due to the Jessica’s inability to take on additional clients during client’s birth month. Upon receiving payment, Jessica will reserve client’s birth on her calendar. The remaining balance is due at 36 weeks gestation. If remaining balance is not paid by 36 weeks, Jessica's obligation to attend the birth is nullified until payment is received.
Due to the unpredictable nature of birth, Jessica works with back-up doula and/or photographer. In the event Jessica cannot attend client’s birth for any reason, or if she needs to leave after 12 hours of support, a back-up may be sent to client’s birth. In the event a back-up is not able to attend, client will receive a refund of payment made, minus retainer.
Client is responsible to keep in contact with Jessica in the weeks leading up to client’s birth. Keep Jessica updated with appointments and if there are any significant changes in the birth plan. In early labor: notify her via call or text, so that she can prepare her family. If Jessica doesn’t respond to text, please call. · In active labor: notify Jessica when contractions are 5 minutes a part, 1 minute long consistently for an hour. Jessica needs 1.5 hours to arrive at client’s birth location.
If client has a precipitous birth and is unable to call Jessica with enough notice, this contract is still valid and she will come to place of birth to document the moments after delivery. Precipitous births are not the fault of client or doula/photographer. Jessica will document client’s birth story – in this case – a fast and unpredictable birth is client’s story, and no monies will be returned. Jessica will deliver the same amount of images as agreed upon in this contract.
If Jessica is unable to perform this contract due to sickness, emergency, or causes beyond her control, Jessica and client shall attempt to schedule a replacement session (fresh 48, newborn session, etc). If an agreement cannot be reached by doula/photographer and client, the doula/photographer agrees to return payments made (minus the retainer). Jessica will have no further liability. If the Jessica is not able to deliver the agreed upon images due to a technical malfunction of her photography equipment, her liability is limited to the price of a birth session.
Birth Doula
As a doula, I accompany women in labor to give you physical, emotional and informational support. I prefer to meet you and your partner twice before labor to become acquainted and discuss your priorities and concerns. I will also assist you in developing a Birth Plan specific to your desired birth experience and check in during the postpartum time as you adjust to life after birth. I am on call two weeks before and after your EDD. Feel free to contact me when you think labor has started. I am happy to answer questions to confirm labor has begun and will meet you at home or the hospital whenever you like during active labor to provide continuous support until baby is born (this is true with all birth methods ie induction, cesarean, natural, etc). I do not perform clinical tasks such as blood pressure, fetal heart rates, or vaginal exams. I am there to provide physical comfort, emotional support, and advocacy to mom and her partner. My goal is to help you find information necessary to make informed decisions before and during birth. I make every effort to fulfill the services described. If I fail to attend your birth or provide back up due to my error, I will refund 80% of your payment. If I am not contacted because of unforeseen circumstances or you fail to call me, I will keep the payment in full. If the back up doula is used I am responsible for her fee.
Birth Photography
Photographer is not liable for any dissatisfaction of the final product as long as it represents photographer’s style and work in her portfolio. Client is responsible for viewing photographer’s website and portfolio. Upon signing this contract, client agrees that photographer’s style and quality of photographs is acceptable. Photographer cannot guarantee print quality unless images are printed through photographer’s professional lab. Photographer is not liable for outside lab dissatisfaction.
The photographer holds copyright for all images taken during the birth session. Any attempt to claim the photos as client’s own will result in lawful action. Any attempt to reproduce photos which you do not have a printing rights agreement for will result in a breach of contract. Photos and prints are for personal use only. Photographer obtains the irrevocable right to utilize photos from your birth session for advertising or commercial purposes. This includes the posting of certain images on advertising materials that include photographer’s website, Facebook page, social media, and printed media in accordance to model release.
It is the client’s responsibility to ensure place of birth (hospital, birth center or homebirth midwife) is aware of the birth photographer and doesn’t have guidelines against birth photography. The birth photographer is not responsible for any missed shots due to medical staff. If the client has a c-section or is an emergency situation, it is client’s responsibility to discuss photographer’s presence in the operating room(OR). If photographer is not allowed in the OR, contract is still fully enforceable. Photographer will document client’s story from the vantage point that she’s allowed access to by hospital staff.
Photographer is hired as sole photographer. Client’s family and friends can also take photos, but photographer is not responsible for missed shots due to interference.
Photographer holds all artistic rights to images she captures during a birth session. Photographer will decide how she wants to edit each photograph. Client agrees to not alter images in any way (this includes filters used on social media). Client agrees to not crop images. If client desires additional editing on any file, photographer reserves the right to charge $25 per file.
Model Release
SOCIAL MEDIA AND MY WEBSITE ARE AN IMPORTANT TOOL FOR ME TO SHARE MY WORK AND INSPIRE OTHER MOTHERS, AS I'M SURE YOU EXPERIENCED WHEN YOU BEGAN YOUR SEARCH FOR A BIRTH PHOTOGRAPHER. I WOULD LOVE TO HAVE THE OPPORTUNITY TO SHARE MODEST IMAGES FROM YOUR BIRTH IN MY PORTFOLIO AND ON MY BLOG OR SOCIAL MEDIA. I TAKE YOUR PRIVACY SERIOUSLY AND WE CAN DISCUSS WHICH PHOTOS MAY BE USED AT OUR CONSULT OR POSTPARTUM VISIT.
I hereby assign full copyright of these photographs to the above-mentioned photographer Jessica Worland with the right of reproduction and distribution. I grant the photographer the right to take, use, and publish photographs, which contain client’s image according to the following specifications: *
